Class actions funding models differ across jurisdictions for historical and policy reasons. In the US, the plaintiffs’ bar is traditionally self- or debt-financed in conjunction with diversification through co-counseling. Whereas in Europe, adverse costs and limitations on contingency representation necessitate third-party funding and after the event insurance. And in Canada, there is a different system all together.
