Comparative Class Action Funding: a Multi-Jurisdictional Examination
Class actions funding models differ across jurisdictions for historical and policy reasons. In the US, the plaintiffs’ bar is traditionally self- or debt-financed in conjunction with diversification through co-counseling. Whereas in Europe, adverse costs and limitations on contingency representation necessitate third-party funding and after the event insurance. And in Canada, there is a different system all together. This topic has increasing importance in light of US firms’ expansion across the Atlantic and the rise of multi-jurisdictional class action campaigns. The panel will explore the benefits and drawbacks of various models, as well as explore whether the US model is ripe for disruption.
