Litigating ESG Consumer Class Actions
Environmental marketing claims, and other ESG marketing claims, have been the subject of an increasing number of consumer class actions. These putative class actions regularly challenge “green” claims that products or services are “carbon neutral,” “recyclable,” “non-toxic,” or otherwise beneficial for the environment. Our panelists are experienced at defending consumer class actions, including cases involving ESG marketing, and will take you through recent trends in this space and what to expect next.

Is the "Forever Chemical" PFAS a Forever Class Action?
It has been called the 'forever chemical'. Although largely phased out, suits and claims have been filed by states and individuals with some states alleging environmental harm, seeking clean up compensation. Despite stringent regulation, PFAS has been linked to harmful health effects, including cancer. Will ongoing regulations from the U.S. Environmental Protection Agency continue to have a material impact? 3M has said it will end its production of PFAS by 2025. Will other chemical companies join 3M?

Camp LeJeune and New Theories of Liability
Water contamination lawsuits were filed against the government alleging adverse health effects for affecting nearly 175,000 marines, sailors, their families and civilians at the camp between 1950 and 1985. Those cases were consolidated into MDL No. 2218 and the government successfully obtained dismissal of all of those cases in 2016. Some plaintiffs continued to litigate based on new theories of liability. Those new claimants petitioned for a new MDL proceeding. That request was denied. Those isolated cases continue to be litigated. A most recent case generating a published decision, Washington v. Department of Navy, was published by a U.S. District Court in North Carolina. Our speaker will take you inside the new case, exploring the most recent legislation pending in Congress about claim allowance and disallowance and who can and can't sue the government.
